Terms and Conditions

1. Acceptance of Terms and Eligibility

These Terms and Conditions ("Terms") govern your access to and use of Cheshyre.com, including The Queen's Court Twitch Extension, Spellbook Inscriptions, account features, character progression, currencies, gear, lootcrates, rewards, Discord integration, and related community game systems (collectively, the "Service"). By accessing or using the Service, signing in with Twitch, or connecting Discord, you agree to these Terms and the Privacy Policy.

You must be at least 13 years old to use the Service. If you are under the age of majority in your state or country of residence, you represent that you are using the Service with the permission of a parent or legal guardian. The Service is not directed to children under 13.

2. Twitch Login and Discord Account Linkage

When you sign in with Twitch, you authorize Chris Heckler ("we," "us," or "our") to use the Twitch information and permissions you approve to create and maintain your site profile, associate gameplay and progression with your Twitch identity, and operate account-linked features.

We will only use Twitch permissions and account data as described in these Terms and the Privacy Policy. If you revoke Twitch authorization, change your Twitch account information, or otherwise restrict access, some or all account-linked features may stop working, and we may suspend, unlink, or delete related account functionality or data as required for security, compliance, or technical operation.

If you choose to connect Discord, you authorize us to associate the Discord identity you approve with your Twitch-backed Queen's Court profile. You may unlink Discord without deleting your underlying character, progression, or broadcaster connection. Discord names and avatars may appear in connected community features as described in the Privacy Policy.

3. Privacy, Policy Acceptance, and Records

By accepting these Terms and the Privacy Policy, you authorize us to record acceptance and compliance information, which may include the date and time of acceptance, policy version, IP address, browser or device information, and related technical records.

We maintain these records for security, fraud prevention, service administration, troubleshooting, legal compliance, dispute resolution, and audit purposes. Our collection and use of personal information is described in the Privacy Policy.

4. Entertainment Use Only; No Cash Value

The Service and all virtual features are provided solely for entertainment and community participation. Characters, levels, currencies, points, items, gear, lootcrates, rewards, unlocks, titles, Spellbook Inscriptions, queued encounter charges, and similar features are digital entertainment elements only.

Except where we expressly state otherwise in separate official rules or written terms, virtual features have no cash value, are not redeemable for money or anything of monetary value, do not constitute stored value or personal property, and may not be sold, transferred, assigned, exchanged, or redeemed outside the Service.

5. Spellbook Inscriptions and Use of Bits

The Spellbook offers fixed, Queen's Court-authored channel effects. When the Extension displays a Spellbook option, selecting Use Bits asks Twitch to confirm the displayed Bits amount and eligibility. Twitch processes the Bits transaction. Broadcasters and viewers cannot define the effect or change its Bits amount.

The fourteen public launch products comprise Wisdom's Ascendance for XP, Gilded Tribute for Gold, Salvager's Bounty for gear-salvage recovery, Battle Dominion for outgoing and incoming damage, Enhanced Quest, and Enhanced Boss. The first four spell families offer one-, three-, and seven-day durations for 250, 500, and 1,000 Bits. The three rate spells apply a 1.5 multiplier to their named rate; salvage recovery remains capped at 100%. Battle Dominion applies 1.5 times outgoing damage and 0.5 times incoming damage. Enhanced Quest and Enhanced Boss each use 250 Bits for one empowered encounter.

Enhanced Quest immediately opens quest recruitment when eligible and no quest or boss is blocking it. A boss lobby, active fight, or unsettled boss result keeps a new Enhanced Quest queued until the boss finishes settling. An active expedition keeps it queued for the next quest. Eligible already-open recruitment claims the oldest queued enhancement at departure. Enhanced Boss is unavailable in the Spellbook until the connected broadcaster enables boss fights. It immediately opens a lobby when its lane is clear, enhances an already-open lobby at activation, and queues behind an active or unsettled fight. An existing quest can continue alongside a subsequently opened boss, but a new Enhanced Quest does not start during a boss encounter.

Queued charges are handled oldest-first. The verified viewer activating an enhanced spell is automatically included in its participation and reward path when eligible, even without prior channel activity. If admission is unavailable, such as being knocked out, already in another boss fight, or missing the recruitment cutoff, the enhancement remains queued instead of being consumed for a party without that viewer. An enhanced charge is consumed only when its quest departs or its boss activates with that viewer included. The inscription does not guarantee victory, a minimum individual reward, or any particular gameplay outcome.

Timed durations count continuous calendar time from the activation recorded by the Service, not time spent live: each day is 24 hours and offline time counts. Using the same timed spell again extends its current end time without increasing that spell's multiplier. Different spell families multiply where their scopes overlap. Encounter modifiers are captured at quest departure or boss activation and continue for that encounter even if a timed spell later expires.

Enhanced Quest and Enhanced Boss double eligible XP, Gold, IP, positive material, reagent, and blueprint-fragment quantities. Their material-quality modifier applies a 2x weighting to same-tier premium-reagent and optional same-tier fragment chances, capped at 100%, but never promotes the encounter's rarity tier. This is the relative modifier shown in the Spellbook, not a complete table of baseline or individual reward probabilities. Actual rewards depend on the encounter and eligible participation. Enhanced Quest also adds 15 points to the final success score, preserving Heroic and Mythic scores above 100; this score is not a probability roll or a guarantee of success. Enhanced Boss also applies 1.5 times outgoing damage and 0.5 times incoming damage.

Only options visibly available in the public Extension may be used. Twitch may make Bits unavailable for a channel or account. Twitch's terms govern Bits availability and transaction processing, including any reversal or refund Twitch permits.

Every Inscription is bound to the broadcaster channel where it is activated and applies to all eligible participants in that channel, not only the viewer activating the spell. Inscriptions are not transferable user-owned items. Queen's Court's verified Twitch transaction and inscription record control activation, duration, queuing, and consumption. Discord may display a public active-spell badge, spell name, number of ready charges, or end time, but that display is informational only and cannot create, extend, consume, transfer, or restore an inscription.

6. Randomized Rewards and Promotional Rules

If the Service includes randomized rewards, such as lootcrates or chance-based item drops, those systems are offered for entertainment only and are subject to balancing, modification, suspension, or removal at any time. A public Spellbook option does not directly return a randomly selected item or lootcrate. Enhanced Quest and Enhanced Boss disclose their 2x same-tier premium-material chance modifier before Use Bits; they do not present a complete baseline reward-probability table. The resulting reward, if any, is determined only through the later encounter.

No payment or use of Bits is necessary to enter a separate giveaway, promotion, or contest, and neither improves prize eligibility or odds. A separate promotion may be governed by additional official rules.

7. Game Changes, Resets, Rollbacks, and Error Correction

We may change, rebalance, reset, remove, discontinue, or replace any aspect of the Service at any time, with or without notice. This includes gameplay rules, progression systems, economy values, inventories, gear, item rarity, reward pools, and account-linked features.

We may investigate bugs, exploits, mistakes, or technical issues and may correct duplicate or improper in-game fulfillment, revoke improperly granted rewards, restore inventories, roll back progression, wipe accounts, or take other corrective action that we reasonably determine is necessary to maintain fairness, security, or service integrity. Twitch controls any reversal of the underlying Bits transaction.

9. Suspension and Termination

We may suspend, restrict, unlink, or terminate your access to the Service, in whole or in part, at any time if we reasonably believe you violated these Terms, abused the Service, created security risk, caused legal or platform-compliance concerns, revoked required authorization, or otherwise acted in a way that threatens the Service or other users.

Upon suspension or termination, you may lose access to your profile, progression, inventory, history, and virtual features, and we are not obligated to restore them unless we choose to do so.

10. User Content, Suggestions, and Feedback

If you submit usernames, character names, chat inputs, text, artwork, suggestions, ideas, bug reports, or other content through the Service, you represent that you have the right to submit that content and that it does not infringe the rights of any third party.

You grant us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, modify for formatting or moderation purposes, and otherwise use that content as reasonably necessary to operate, improve, promote, and moderate the Service and related community features.

If you provide suggestions or feedback, you agree that we may use them without restriction or compensation.

11. Intellectual Property

The Service, including its design, software, text, graphics, artwork, story elements, game mechanics, branding, and audiovisual content, is owned by Chris Heckler or its licensors and is protected by intellectual property and other laws.

These Terms do not grant you ownership of the Service or any content in it. Except as expressly permitted by us in writing, you may not copy, reproduce, distribute, sell, sublicense, reverse engineer, create derivative works from, or commercially exploit the Service or its content.

12. Third-Party Services and Twitch Non-Affiliation

The Service may rely on third-party services, including Twitch, Discord, hosting providers, analytics tools, payment tools, and other infrastructure providers. We are not responsible for third-party services, content, outages, or policies.

The Service is an independent community service and is not sponsored, endorsed, administered by, or officially affiliated with Twitch or Discord unless we expressly say so. Twitch and Discord names, logos, and trademarks remain the property of their respective owners.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

We do not guarantee continued availability of any feature, progression, virtual item, or user account history.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHRIS HECKLER AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, MODERATORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR VIRTUAL ITEMS, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE OR (B) FIFTY U.S. DOLLARS (US$50.00).

Some jurisdictions do not allow certain warranty disclaimers or liability limitations, so some of the above may not apply to you.

15. Indemnification

You agree to defend, indemnify, and hold harmless Chris Heckler and its owners, officers, employees, contractors, moderators, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the Service, your violation of these Terms, your violation of applicable law, or your infringement of any third-party rights.

16. Changes to the Service and These Terms

We may update the Service and these Terms at any time. If we make material changes, we may post an updated version on the website and update the effective date above. Your continued use of the Service after revised Terms become effective constitutes acceptance of the updated Terms.

17. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Sacramento, California, and you consent to personal jurisdiction and venue in those courts.

18. Severability and Entire Agreement

If any provision of these Terms is held unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect.

These Terms, together with the Privacy Policy and any separate official rules that expressly apply to a specific event or feature, form the entire agreement between you and us regarding the Service and supersede prior understandings relating to the same subject matter.
