1. Acceptance of Terms and Eligibility

These Terms and Conditions ("Terms") govern your access to and use of Cheshyre.com, including The Queen's Court account features, character progression, currencies, gear, lootcrates, rewards, and related community game systems (collectively, the "Service"). By accessing or using the Service, or by signing in with Twitch, you agree to these Terms and the Privacy Policy.

You must be at least 13 years old to use the Service. If you are under the age of majority in your state or country of residence, you represent that you are using the Service with the permission of a parent or legal guardian. The Service is not directed to children under 13.

2. Twitch Login and Account Linkage

When you sign in with Twitch, you authorize Chris Heckler ("we," "us," or "our") to use the Twitch information and permissions you approve to create and maintain your site profile, associate gameplay and progression with your Twitch identity, and operate account-linked features.

We will only use Twitch permissions and account data as described in these Terms and the Privacy Policy. If you revoke Twitch authorization, change your Twitch account information, or otherwise restrict access, some or all account-linked features may stop working, and we may suspend, unlink, or delete related account functionality or data as required for security, compliance, or technical operation.

3. Privacy, Policy Acceptance, and Records

By accepting these Terms and the Privacy Policy, you authorize us to record acceptance and compliance information, which may include the date and time of acceptance, policy version, IP address, browser or device information, and related technical records.

We maintain these records for security, fraud prevention, service administration, troubleshooting, legal compliance, dispute resolution, and audit purposes. Our collection and use of personal information is described in the Privacy Policy.

4. Entertainment Use Only; No Cash Value

The Service and all virtual features are provided solely for entertainment and community participation. Characters, levels, currencies, points, items, gear, lootcrates, rewards, unlocks, titles, and similar features are digital entertainment elements only.

Except where we expressly state otherwise in separate official rules or written terms, virtual features have no cash value, are not redeemable for money or anything of monetary value, do not constitute stored value or personal property, and may not be sold, transferred, assigned, exchanged, or redeemed outside the Service.

5. Randomized Rewards and Promotional Rules

If the Service includes randomized rewards, such as lootcrates or chance-based item drops, those systems are offered for entertainment only and are subject to balancing, modification, suspension, or removal at any time.

Unless separate official rules expressly state otherwise for a specific event, giveaway, promotion, or contest: no purchase is necessary to participate in the Service, and making a purchase, subscription, donation, tip, Bits contribution, or other payment does not improve the odds of receiving any randomized reward.

If we run a separate giveaway, contest, promotion, sponsorship, or prize event, that activity may be governed by separate official rules in addition to these Terms.

6. Game Changes, Resets, Rollbacks, and Error Correction

We may change, rebalance, reset, remove, discontinue, or replace any aspect of the Service at any time, with or without notice. This includes gameplay rules, progression systems, economy values, inventories, gear, item rarity, reward pools, and account-linked features.

We may investigate bugs, exploits, mistakes, or technical issues and may correct them by reversing transactions, revoking improperly granted rewards, restoring inventories, rolling back progression, wiping accounts, or taking other corrective action that we reasonably determine is necessary to maintain fairness, security, or service integrity.

We may suspend, restrict, unlink, or terminate your access to the Service, in whole or in part, at any time if we reasonably believe you violated these Terms, abused the Service, created security risk, caused legal or platform-compliance concerns, revoked required authorization, or otherwise acted in a way that threatens the Service or other users.

Upon suspension or termination, you may lose access to your profile, progression, inventory, history, and virtual features, and we are not obligated to restore them unless we choose to do so.

9. User Content, Suggestions, and Feedback

If you submit usernames, character names, chat inputs, text, artwork, suggestions, ideas, bug reports, or other content through the Service, you represent that you have the right to submit that content and that it does not infringe the rights of any third party.

You grant us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, modify for formatting or moderation purposes, and otherwise use that content as reasonably necessary to operate, improve, promote, and moderate the Service and related community features.

If you provide suggestions or feedback, you agree that we may use them without restriction or compensation.

10. Intellectual Property

The Service, including its design, software, text, graphics, artwork, story elements, game mechanics, branding, and audiovisual content, is owned by Chris Heckler or its licensors and is protected by intellectual property and other laws.

These Terms do not grant you ownership of the Service or any content in it. Except as expressly permitted by us in writing, you may not copy, reproduce, distribute, sell, sublicense, reverse engineer, create derivative works from, or commercially exploit the Service or its content.

11. Third-Party Services and Twitch Non-Affiliation

The Service may rely on third-party services, including Twitch, hosting providers, analytics tools, payment tools, and other infrastructure providers. We are not responsible for third-party services, content, outages, or policies.

The Service is an independent community service and is not sponsored, endorsed, administered by, or officially affiliated with Twitch unless we expressly say so. Twitch names, logos, and trademarks remain the property of Twitch and their respective owners.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

We do not guarantee continued availability of any feature, progression, virtual item, or user account history.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHRIS HECKLER AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, MODERATORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR VIRTUAL ITEMS, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE OR (B) FIFTY U.S. DOLLARS (US$50.00).

Some jurisdictions do not allow certain warranty disclaimers or liability limitations, so some of the above may not apply to you.

You agree to defend, indemnify, and hold harmless Chris Heckler and its owners, officers, employees, contractors, moderators, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the Service, your violation of these Terms, your violation of applicable law, or your infringement of any third-party rights.

15. Changes to the Service and These Terms

We may update the Service and these Terms at any time. If we make material changes, we may post an updated version on the website and update the effective date above. Your continued use of the Service after revised Terms become effective constitutes acceptance of the updated Terms.

16. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Sacramento, California, and you consent to personal jurisdiction and venue in those courts.

Optional attorney-review clause: You may replace this section with a lawyer-drafted dispute resolution, arbitration, and class-action waiver provision if desired.

17. Severability and Entire Agreement

If any provision of these Terms is held unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect.

These Terms, together with the Privacy Policy and any separate official rules that expressly apply to a specific event or feature, form the entire agreement between you and us regarding the Service and supersede prior understandings relating to the same subject matter.
